Last week we were blessed with TWO victories over the Christie’s Cabaret ownership group who want to build and operate an “upscale adult entertainment” venue on the northwest corner of Camelback Road and Interstate 17.
- We learned that the Arizona State Court of Appeals issued a “memorandum upholding the lower court’s decision.” The CC group asked for a use permit in 2007 and it was denied by the City of Phoenix. They filed suit in Superior Court to overturn the city’s decison. Now, the Court of Appeals has affirmed that the city acted properly.
- The CC group withdrew their liquor license application that was to be heard by the city on Wednesday afternoon. They “pulled” their application because they realized they weren’t going to succeed . . . because of the overwhelming stream of letters and emails that were sent to City Hall.
REALITY CHECK: The Christie’s Caberet ownership group will not give up. They have lots of money to spend on legal fees. They currently operate establishments in 12 cities across our nation. I have been told that their “best” establishment generates a NET PROFIT above $50,000 per day! They have two courses of action available to them.
- Appeal the Court of Appeal’s decision to the Arizona Supreme Court.
- Go directly to the federal level and the U.S. District Court of Appeals for the Ninth Circuit.
I have no doubts that they will appeal, so although we have won another battle, the war is not yet over.
